Tujuh keterangan saksi penting dalam kes mahkamah terowong Lim Guan Eng (setakat 17 Dis 2021)

Pertama, Guan Eng didakwa sebelum siasatan forensik dijalankan.

Dalam laporan berita pada 13 Julai 2021, pegawai Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) Saadon Abd Samad mengakui Guan Eng didakwa sebelum siasatan forensik dijalankan.

Ketika ditanya mengapa siasatan hanya dibuat selepas Guan Eng didakwa, pegawai SPRM itu menjawab bahawa bukan dia yang membuat keputusan.

Kedua, tiada unsur jahat dalam pembayaran pertukaran tanah.

Bekas Exco Pulau Pinang Lim Hock Seng memberi keterangan di mahkamah pada 19 Ogos 2021 bahawa pembayaran pertukaran tanah kepada kontraktor adalah bersih dan telus – tiada unsur yang jahat.

Kontraktor Consortium Zenith-BUCG Sdn Bhd memfailkan tuntutan mereka untuk kajian kebolehlaksanaan yang lengkap dan reka bentuk terperinci untuk tiga jalan utama.

Tuntutan itu disemak dan disahkan secara bebas oleh perunding kejuruteraan HSS Integrated Sdn Bhd sebelum kertas kerja diserahkan kepada Exco Pulau Pinang untuk pertimbangan membayar kontraktor.

Tiada bayaran dibuat untuk kerja yang tidak lengkap termasuk terowong dasar laut. Semua bayaran setakat ini adalah untuk kerja yang telah siap.

Ketiga, 3 projek jalan utama dan terowong dasar laut telah diberikan melalui tender terbuka

Saksi Lim Hock Seng memberi keterangan di mahkamah bahawa Guan Eng telah berulang kali menekankan bahawa projek-projek ini akan melalui proses tender terbuka.

Guan Eng telah mengumumkan perkara ini dalam Dewan Undangan Negeri Pulau Pinang dan secara jelas dimaklumkan kepada kontraktor semasa mesyuarat.

Lapan syarikat yang layak telah menyertai tender terbuka.

Keempat, syarikat yang memenangi tender terbuka tidak mempunyai kelebihan

Penolong Pengarah Unit Perancang Ekonomi Negeri Pulau Pinang ketika itu, Azrai Zaini memberi keterangan di mahkamah pada 20 Ogos 2021 bahawa Kumpulan Pembinaan Bandar Beijing (BUCG) sebagai sebahagian daripada konsortium yang memenangi bidaan tidak mempunyai kelebihan dalam proses tender terbuka.

Saksi Dato’ Seri Farizan Bin Darus, bekas Setiausaha Kerajaan Negeri Pulau Pinang, telah memberi keterangan pada 11 November 2021 bahawa syor yang diberikan oleh Jawatankuasa Teknikal dan Kewangan Negeri dan Lembaga Pemerolehan untuk menganugerahkan kontrak kepada Konsortium Zenith-BUCG dibuat secara bebas daripada Guan Eng atau mana-mana ahli politik.

Penilaian profesional oleh kedua-dua jawatankuasa itu tidak melibatkan Guan Eng atau EXCO atau ahli politik.

Konsortium Zenith-BUCG telah dianugerahkan kontrak itu kerana syarikat itu mendapat markah tertinggi dalam kalangan pembida.

Kelima, kos projek telah dikurangkan, menjimatkan berbilion wang Kerajaan Negeri Pulau Pinang

Semasa perbicaraan pada 11 November 2021, Dato’ Seri Farizan Bin Darus yang mempengerusikan Lembaga Pemerolehan memberi keterangan bahawa Guan Eng telah menjimatkan beberapa bilion wang kerajaan negeri dengan mengurangkan saiz tanah yang perlu dibayar untuk projek-projek daripada 157 ekar kepada 110 ekar.

Beliau juga berkata proses perolehan 3 jalan utama dan terowong dasar laut itu dijalankan mengikut prinsip cekap, akauntabel dan telus.

Keenam, penggubalan kontrak projek telah dirunding dengan Penasihat Undang-undang Kerajaan Negeri Pulau Pinang

Bekas Penasihat Undang-undang Kerajaan Negeri Pulau Pinang, Faiza Zulkifli telah memberikan keterangan di mahkamah pada 12 November 2021 bahawa beliau hadir dan tidak diketepikan dalam mesyuarat di mana kontrak untuk projek itu dibincangkan.

Firma guaman yang dilantik untuk merangka kontrak ialah Lee Hishammuddin Allen & Gledhill, sebuah firma guaman berprestij tinggi di Asia-Pasifik. Peguam yang merangka perjanjian itu ialah Adlin Abdul Majid, yang kini merupakan Pesuruhjaya Kehakiman di Kuala Lumpur. Faiza Zulkifli tidak membantah pelantikan firma guaman itu untuk merangka kontrak.

Ketujuh, kenyataan ahli Umno yang mendakwa Guan Eng minta komisen 10% keuntungan mengandungi dakwaan yang tidak konsisten

Keterangan itu dibacakan di mahkamah pada 17 Disember 2021 oleh Pengarah Eksekutif Kanan Konsortium Zenith Construction Sdn Bhd Zarul Ahmad Mohd Zulkifli, ahli Umno, yang mendakwa Guan Eng minta 10% keuntungan mengandungi dakwaan tidak konsisten dengan versi yang diberikannya kepada SPRM tiga tahun yang lalu.

Secara ringkasnya, daripada keterangan saksi sehingga 17 November 2021, kami tahu bahawa:

  7. Kenyataan ahli Umno yang mendakwa Guan Eng meminta komisen 10% keuntungan mengandungi dakwaan yang tidak konsisten.

林冠英海底隧道案中7个重要的证人供词(截至2021年12月17日):

一、林冠英在鉴证调查开始前就已被起诉

在 2021 年 7 月 13 日的新闻报道中,反贪污委员会官员沙顿(Saadon Abd Samad)证实,林冠英在鉴证调查开始前就已被起诉。

当被问及为何要在关英被起诉后才展开调查时,该官员回答指,这不是他所能的决定。

二、用地付费没有涉嫌舞弊

三名证人供词证实至今仍未为海底隧道计划付款。 所有款项均用于支付已完成的3条主要大道的可行性研究和详细设计。
前槟城行政议员林峰成于 2021 年 8 月 19 日在法庭上作证表示,转让槟州政府拥有的土地来支付槟城海底隧道的项目费用,并不存在问题。

承包商 Consortium Zenith-BUCG Sdn Bhd 就已完成的三条主要大道可行性研究和初步设计提出请款。

工程顾问HSS Integrated Sdn Bhd 对该请款进行了独立审核,然后才将工作文件提交给槟州行政议会,以考虑向承包商付款。

州政府并没有为尚未完成的工作支付任何费用,其中包括海底隧道工程。到目前为止,所有付款都是用来支付已完成的工作。

证人林峰成在法庭上作证指出,林冠英一再强调这些项目将进行公开招标。

四、得标企业并没有优势

2021 年 8 月 20 日,时任槟州经济规划部门基础设施助理主任莫哈末阿兹莱(Azrai Zaini)在法庭上作证指出,北京城建集团(BUCG)作为得标财团的一份子,在公开招标过程中没有优势。

前槟州秘书拿督斯里法力占(Dato’Seri Farizan Bin Darus)于 2021 年 11 月 11 日作证表示,技术与财务评估委员会和招标局提出将合同授予 Consortium Zenith-BUCG 的建议是独立于冠英或任何政治人物。

两个委员会的专业评估不涉及林冠英或行政议员或政治人物。

五,计划成本降低,为槟州政府节省数十亿令吉

在 2021 年 11 月 11 日的审讯时,主持招标局的拿督斯里法力占作证指出,林冠英将计划中的支付土地面积从 157 英亩减少到 110 英亩,为州政府节省了数十亿令吉。

他还表示,3条主要大道和海底隧道的采购过程是基于高效、问责和透明的原则进行。

六、计划的初步合约已咨询槟州政府法律顾问

槟州政府前法律顾问拿督法依扎(Faiza Zulkifli)于 2021 年 11 月 12 日在法庭上作证指,她出席了讨论计划合约的会议,并且没有遭到边缘化。

指定起草合约的律师事务所,是亚太地区首屈一指的律师事务所 Lee Hishammuddin Allen & Gledhill。 起草初步合约的律师是亚德林(Adlin Abdul Majid),对方目前是高庭司法专员。 法依扎当时并不反对任命律师事务所起草合约。

七,一名巫统成员声称林冠英要求受贿10% 收益的证词前后矛盾

Zenith建筑集团主席兼执行董事,同时也是巫统党员的查鲁(Zarul Ahmad Mohd Zulkifli)于2021年12月17日在法庭上作出的书面证词,指林冠英要求受贿海底隧道计划未来10%盈利的供词,与3年前对反贪会作出的供词有前后矛盾。
案件将在明年3月23日继续审讯。

7 crucial witness testimonies heard in Lim Guan Eng’s trial (as of Dec 17, 2021):

First, Guan Eng was charged before forensic investigation was conducted.

In a news report on July 13, 2021, the Malaysian Anti-Corruption Commission (MACC) officer Saadon Abd Samad admitted that Guan Eng was charged before forensic investigation was conducted.

When asked why the investigation only came after Guan Eng was charged, the MACC officer replied that the decision was not his to make.

Second, nothing sinister in the land swap payment, and no payment has been made for the undersea tunnel.

Three witnesses have testified that no payment has been made for the undersea tunnel. All the payments made were for the completed feasibility studies and detailed designs of the 3 major roads.

Former Penang executive councillor Lim Hock Seng testified in court on 19 August 2021 that the land swap payment to contractor was clean and transparent – nothing sinister.

The contractor Consortium Zenith-BUCG Sdn Bhd filed their claims for the completed feasibility studies and detailed design for three major roads.

The claim was independently checked and verified by engineering consultant HSS Integrated Sdn Bhd before working paper is submitted to the Penang executive council for consideration to pay the contractor.

No payment was made for incomplete work including the undersea tunnel. All payment so far was for completed work.

On December 16 session, the former state financial officer, Datuk Mokhtar Mohd Jait similarly testified that only the completed feasibility studies and detailed designs of the 3 roads were paid. Nothing has been paid for the undersea tunnel.

Penang state executive councillor for Infrastructure and Transportation Zairil Khir Johari told the Sessions Court on December 17 that no payment has been made for the undersea tunnel.

Third, the 3 major roads and undersea tunnel projects were awarded through open tender.

Witness Lim Hock Seng testified in court that Guan Eng has repeatedly emphasised that these projects will go through open tender.

Guan Eng has announced this at the Penang State Assembly and explicitly made known to the contractor during meetings.

Fourth, the company that won the open tender did not have an advantage.

The then assistant director in the Penang State Economic Planning Unit, Azrai Zaini testified in court on 20 August 2021 that the Beijing Urban Construction Group (BUCG) as part of the consortium that won the bidding did not have an advantage in the open tender process.

Witness Dato’ Seri Farizan Bin Darus, the former Penang State Secretary, has testified on 11 November 2021 that the recommendation given by Jawatankuasa Teknikal dan Kewangan Negeri and Lembaga Pemerolehan to award the contract to Consortium Zenith-BUCG was made independently from Guan Eng or any politician.

The professional evaluation by the two committees did not involve Guan Eng or executive councillor or politician.

Consortium Zenith-BUCG was awarded the contract because the company was given the highest score among the bidders.

Fifth, the projects’ cost was reduced, saving billions for Penang State Government.

During the trial on 11 November 2021, Dato’ Seri Farizan Bin Darus who chaired the Lembaga Pemerolehan testified that Guan Eng has saved the state government several billions by reducing the land size to be paid for the projects from 157 acres to 110 acres.

He has also said that the procurement process of the 3 major roads and undersea tunnel was conducted based on the principles of competency, accountability, and transparency.

Sixth, the drafting of the projects’ contracts has consulted Penang state government’s legal advisor.

Former legal advisor for the Penang government, Faiza Zulkifli has testified in court on 12 November 2021 that she was present and was not sidelined at the meetings where the contracts for the projects were discussed.

The law firm appointed to draft the contracts was Lee Hishammuddin Allen & Gledhill, a top-ranking law firm in Asia-Pacific. The lawyer who drafted the agreements was Adlin Abdul Majid, who is currently a judicial commissioner in Kuala Lumpur. Faiza Zulkifli did not object to the appointment of the law firm to draft the contracts.

Seventh, the statement by an Umno member claiming that Guan Eng asked for 10% profit contained alleged inconsistency.

The testimony read out in court on 17 December 2021 by Consortium Zenith Construction Sdn Bhd senior executive director Zarul Ahmad Mohd Zulkifli, an Umno member, which claimed that Guan Eng has asked for 10% profit, contained alleged inconsistency with the version he gave to MACC three years ago.

The trial will resume on March 23, 2022.
