Penang unable to have a Freedom of Information enactment

GEORGE TOWN (Nov 30, 2009) : The Penang government is unable to pursue a new Freedom of Information (FOI) Act as it has been told by its state legal adviser that such a move comes under the ambit of the federal government.

“We have been advised by the state legal adviser (Faiza Zulkifli) that to do so would be unconstitutional,” Chief Minister Lim Guan (DAP-Ayer Puteh) told a press conference at the State Assembly here.

“As much as we disagree with her, we are bound to her views. She is our legal counsel,” Lim said when commenting on a reply by state executive councillor Abdul Malik Abul Kassim (PKR-Batu Maung) to a question by Teh Yee Cheu (DAP-Tanjung Bungah) on the status of the state’s implementation of the policy.

Abdul Malik had said the state would now watch the Selangor government’s move to implement such a law, which is expected next year.

“We are awaiting the outcome of the Selangor government’s move to table the bill. If Selangor can do it, why not other states?” asked Lim.

He said Pakatan Rakyat MPs had raised the matter on the formation of a federal FOI Act but had been unsuccessful.

Earlier, Malik, who is also the state religious affairs committee chairman, had revealed that representatives of the state government had proposed a new candidate to head the Penang Islamic Affair Council (MAIPP) following the lapsing of the tenure of Umno’s Shahbudin Yahaya as its president.

Malik said the representatives had been granted an audience with the Yang di-Pertuan Agong on Nov 18 to give their proposed name.

Datuk Roslan Saidin (BN-Permatang Berangan) questioned why the state was proposing a new name when the King had earlier decided on another person to replace Shahbudin.

Malik said the King had agreed to meet them to hear their proposal, and the state was entitled to suggest a name under the Penang Administration of Islamic Affairs Enactment.

“The state government may propose new names. The decision is up to the Agong. This issue should not be politicised,” he added.
